Terms & Conditions.

Agreement to terms

By accessing or using the Unomena (Pty) Ltd (“Unomena”) website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our website or services.

Services

Unomena provides design, development, and digital services as described on our website. All project engagements are subject to a separate statement of work or proposal agreed upon by both parties. The scope, timeline, and deliverables for each project will be defined in the relevant project agreement.

Intellectual property

All content on this website, including text, graphics, logos, images, and software, is the property of Unomena or its content suppliers and is protected by applicable intellectual property laws. Upon full payment, clients receive ownership of custom work produced specifically for their project, unless otherwise stated in the project agreement.

Payment terms

  • A 50% deposit is required to commence work on any project.
  • The remaining 50% is due upon project completion, unless milestone-based payments have been agreed upon.
  • All invoices are payable within 14 days of issue.
  • Late payments may incur interest at 2% per month on the outstanding balance.
  • Unomena reserves the right to suspend work on any project with outstanding payments.

Limitation of liability

Unomena shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our website or services. Our total liability for any claim arising from our services shall not exceed the total fees paid by you for the specific project in question.

Termination

Either party may terminate a project engagement with 30 days written notice. In the event of termination, the client shall pay for all work completed up to the date of termination. Unomena will provide all completed deliverables upon receipt of final payment.

Governing law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa.
